Introduction Welcome to Captured Media, a Raleigh, NC-based photography and videography business owned by Wanda Nzinga Harris. These Terms and Conditions (“Agreement”) govern your use of our website [capturedmedia.com] and our services, including event, concert, portrait, commercial, fashion, and product photography and videography. By accessing our website or booking our services, you agree to be bound by these terms. If you do not agree, please do not use our website or services.
Services Provided Captured Media provides professional photography and videography services as outlined in your booking agreement or client contract. Deliverables, such as the number of edited images or video length, will be specified in writing before the project begins. Any additional services or changes to the scope require mutual agreement and may incur extra costs.
Payment Terms: A non-refundable deposit of 20% is required at booking to secure your date, with the remaining balance due 7 days before the shoot or upon delivery of final deliverables, as specified in the booking agreement. Payments are accepted via Stripe. Late payments incur a 5% fee per week. Prices exclude North Carolina sales tax (7% in Wake County), which clients are responsible for unless exempt. All transaction fees (e.g., 2.9%+ $0.30 for Stripe) are borne by the client.
Cancellation and Refund Policy: Clients may cancel services with written notice. Deposits are non-refundable. Cancellations within 7 days of the scheduled shoot incur a 50% fee of the total project cost; cancellations within 48 hours incur the full fee. Captured Media may cancel due to unforeseen circumstances (e.g., illness, equipment failure), offering a full refund or rescheduling at no additional cost. No refunds are provided for completed services or delivered products.
Intellectual Property and Usage Rights: All images and videos created by Captured Media remain our intellectual property. Clients receive a non-exclusive, non-transferable license for personal or commercial use as outlined in the booking agreement (e.g., social media posts, marketing materials). Clients may not edit, sell, or distribute content without written consent from Captured Media. We reserve the right to use deliverables for promotional purposes (e.g., portfolio, website, social media) unless you opt out in writing at booking.
Limitation of Liability: Captured Media is not liable for losses or damages arising from our services, including but not limited to equipment failure, missed shots, or dissatisfaction with deliverables, except in cases of gross negligence. Our liability is limited to the amount paid for services. We are not responsible for third-party actions (e.g., venues, vendors) or content posted by clients. Clients assume responsibility for any injuries or damages during shoots unless caused by our negligence.
Client Conduct and Safety: Clients and their guests must act respectfully and comply with venue rules and safety guidelines. Captured Media may terminate services without refund if unsafe, abusive, or disruptive behavior occurs. Clients are responsible for securing necessary permits (e.g., venue access, drone usage) unless otherwise agreed in writing.
Data Privacy: Captured Media collects personal information (e.g., name, email, event details) to provide services and process bookings. We do not share your data with third parties except as required for service delivery (e.g., payment processors). Dispute Resolution and Governing Law: Any disputes arising from this Agreement will be resolved through mediation in Raleigh, NC, before pursuing legal action. This Agreement is governed by the laws of North Carolina. Clients agree to cover reasonable legal fees if Captured Media prevails in a dispute.
