Introduction: Welcome to Captured Media LLC, a Raleigh, North Carolina–based photography and videography business owned and operated by Nzinga Harris. These Terms and Conditions (“Terms” or “Agreement”) govern your use of our website, [capturedmedianc.com], and any videography, photography, or related creative services we provide.
Our services may include event, concert, portrait, headshot, commercial, political, and real-estate photography and videography. By accessing or using our website, inquiring about, booking, or receiving our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or book our services.
Services Provided: Captured Media LLC provides professional videography and photography services as outlined in your booking agreement or client contract. Deliverables, such as the number of edited images or video length, will be specified in writing before the project begins. Any additional services or changes to the scope require mutual agreement and may incur extra costs.
Payment Terms: A non-refundable retainer of 50% is required at booking to secure your date, with the remaining balance due forty-eight (48) hours before date of your filming or photography session. Payments are accepted via Stripe. Prices include North Carolina sales tax (7% in Wake County), which clients are responsible for unless exempt. All transaction fees (e.g., 2.9%+ $0.30 for Stripe) are borne by the client.
Cancellation, Rescheduling and Refund Policy: Clients may cancel services with written notice. Deposits are non-refundable. Cancellations within seven (7) days of the scheduled shoot incur a 50% fee of the total project cost; cancellations within 48 hours incur the full fee. Captured Media LLC may cancel due to unforeseen circumstances (e.g., illness, equipment failure), offering a full refund or rescheduling at no additional cost. No refunds are provided for completed services or delivered products. Client must give a minimum of 2 days to reschedule shoot(s).
Intellectual Property and Usage Rights: All images and videos created by Captured Media LLC remain our intellectual property. Clients receive a non-exclusive, non-transferable license for personal or commercial use as outlined in the booking agreement (e.g., social media posts, marketing materials). Clients may not edit, sell, or distribute content without written consent from Captured Media LLC. We reserve the right to use deliverables for promotional purposes (e.g., portfolio, website, social media) unless you opt out in writing at booking.
Limitation of Liability: Captured Media LLC is not liable for losses or damages arising from our services, including but not limited to equipment failure, missed shots, or dissatisfaction with deliverables, except in cases of gross negligence. Our liability is limited to the amount paid for services. We are not responsible for third-party actions (e.g., venues, vendors) or content posted by clients. Clients assume responsibility for any injuries or damages during shoots unless caused by our negligence.
Client Conduct and Safety: Clients and their guests must act respectfully and comply with venue rules and safety guidelines. Captured Media LLC may terminate services without refund if unsafe, abusive, or disruptive behavior occurs. Clients are responsible for securing necessary permits (e.g., venue access, parking) unless otherwise agreed in writing.
Data Privacy: Captured Media LLC collects personal information (e.g., name, cellphone number, email, event details) to provide services and process bookings. We do not share your data with third parties except as required for service delivery (e.g., payment processors). Dispute Resolution and Governing Law: Any disputes arising from this Agreement will be resolved through mediation in Raleigh, NC, before pursuing legal action. This Agreement is governed by the laws of North Carolina. Clients agree to cover reasonable legal fees if Captured Media LLC prevails in a dispute.
Changes to Terms: Captured Media LLC may update these Terms and Conditions at any time. Changes will be posted on [capturedmedianc.com/terms-and-conditions] and take effect immediately. Continued use of our website or services constitutes acceptance of updated terms. We encourage you to review this page periodically.
Failure to Pay: Captured Media LLC will withhold deliverables if full payment is not received within the time frame agreed upon prior to services being provided. Twenty percent (20%) of the value of the services will be added every 48 hours until full payment is made. The client’s account will be sent to collections if payment isn’t received 30 days after the previously agreed-upon payment due date.
Revision and Feedback Policy: Captured Media LLC includes two (2) rounds of revisions. A “round of revisions” is defined as a single consolidated set of change requests submitted at one time after delivery of the draft files (examples: timing adjustments, color corrections, trimming, or swapping approved takes). Round 1 is intended for structural changes (reordering, cutting/adding scenes, major timing adjustments); Round 2 is intended for polishing changes (color, audio levels, minor timing tweaks, caption text). Requests that materially change the project scope (additional shooting, major re-editing, new deliverables, or reshoots) are out of scope and will be estimated and billed separately. All revision requests must be submitted in writing within seven (7) days of delivery of the draft. If no written feedback is received within this period, the deliverable will be considered approved and final. Additional revisions beyond the included two rounds will be billed at the rate of fifty dollars ($50) per hour (minimum 1 hour), or may be offered as a fixed-fee add‑on as agreed in writing before work begins. Emergency or expedited revision requests may incur an additional rush fee. We will correct any material errors made by Captured Media LLC at no additional charge; subjective preference changes after final approval are not considered defects. Final delivery will occur after all included revisions are completed and all outstanding invoices related to the project have been paid in full.
Turnaround Time: Final deliverables will be completed and delivered within seven (7) business days of the project date, unless otherwise discussed and agreed upon in writing. Turnaround times may vary for larger projects, additional revisions, or delays in receiving required client materials.
